Welcome to PlantDoc! The terms “we,” “us,” and “our” refer to PlantDoc, based in Portland, Oregon. PlantDoc operates this store and website, including all related information, content, features, tools, products, and services to provide you with a curated shopping experience (the “Services”). The Services are powered by Shopify.

By visiting or using our Services, you agree to be bound by these Terms of Service. If you do not agree, please do not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

You represent that you have the legal capacity to enter into these Terms. No account creation is required to make a purchase; however, you may provide information for checkout or to opt in to marketing communications. You are responsible for providing accurate, complete, and current information.

SECTION 2 — OUR PRODUCTS

We sell patented, biodegradable plant moisture meters made of paper. They are designed to biodegrade naturally over time. You acknowledge that cosmetic changes such as browning or discoloration are normal and expected.

We do not guarantee plant survival. We guarantee readability for at least one month with proper use. No additional warranties are provided beyond those expressly stated.

SECTION 3 — ORDERS

Orders placed through our Services constitute offers to purchase products. We reserve the right to accept or decline orders at our discretion. Once we accept your order and payment is processed, we will ship your item.

All purchases are subject to our Refund Policy, which allows refunds within 30 days if eligible.

SECTION 4 — PRICES AND BILLING

Prices and promotions may change without notice. You agree to provide accurate payment and shipping information and authorize us to charge your payment method for all orders.

SECTION 5 — SHIPPING AND DELIVERY

We currently ship only within the United States. Delivery timelines are estimates and not guaranteed. Title and risk of loss pass to you once we hand items to the carrier.

SECTION 6 — INTELLECTUAL PROPERTY

All content and designs, including the PlantDoc moisture meter, are protected by U.S. and foreign intellectual property laws. You may not reproduce, modify, or use them without our prior written permission.

SECTION 7 — USER CONTENT AND REVIEWS

You may submit reviews, photos, or other content. By doing so, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display this content in connection with our Services. We may remove content at our discretion if it violates these Terms or applicable law.

SECTION 8 — PRIVACY

We collect and use personal information as described in our Privacy Policy. We do not sell or share your data and comply with Shopify’s privacy standards. You can opt in or out of marketing communications at any time.

SECTION 9 — PROHIBITED USES

You may not misuse our Services, including using them for illegal purposes, harassing others, or attempting to reverse-engineer our products.

We may suspend or terminate your access to the Services at any time without notice if you violate these Terms.

To the fullest extent permitted by law, PlantDoc shall not be liable for any indirect, incidental, consequential, or punitive damages, including any loss of plants or emotional distress.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so these limitations may not apply to you.

SECTION 13 — INDEMNIFICATION

You agree to indemnify and hold harmless PlantDoc and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms or your misuse of the Services.

SECTION 14 — GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. You agree that any dispute shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to the jurisdiction of such courts.

SECTION 15 — FORCE MAJEURE

We are not responsible for any failure or delay in performing our obligations under these Terms if caused by events beyond our reasonable control, including but not limited to natural disasters, acts of war, pandemics, labor disputes, government actions, or interruptions in transportation or utilities.

SECTION 16 — SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

SECTION 17 — CHANGES

We reserve the right to update these Terms at any time. Changes take effect once posted on our website. Continued use of the Services after changes means you accept the updated Terms.
